Welcome to the Enerlytica Employee Management System (EEMS). By accessing or using our employee management system, you agree to be bound by these Terms of Service. Please read them carefully.
1. Acceptance of Terms
By creating an account or using EEMS, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our service.
2. Description of Service
EEMS is a cloud-based employee management system that allows organizations to:
- Manage employee records and information
- Track and approve leave requests
- Store and share employee documents
- Generate workforce reports
3. Account Registration
To use EEMS, you must:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be at least 18 years old or have legal authority to enter into this agreement
4. Free Trial
New accounts receive a 7-day free trial. During the trial period:
- You have full access to all features
- No credit card is required
- Your data will be retained if you subscribe after the trial
- If you do not subscribe, your account may be suspended
5. Subscription and Payment
After the trial period, continued use requires a paid subscription:
- Subscriptions are billed monthly
- Payments are processed securely through Paystack
- Prices are displayed in ZAR (South African Rand) or USD
- You may cancel your subscription at any time
- Refunds are not provided for partial months
6. Acceptable Use
You agree not to:
- Use the service for any illegal purpose
- Upload malicious content or malware
- Attempt to gain unauthorized access to our systems
- Share your account credentials with unauthorized users
- Use the service to harass, abuse, or harm others
- Violate any applicable laws or regulations
7. Data and Privacy
Your data belongs to you. We do not sell or share your employee data with third parties. We only access your data to provide and improve our service.
You are responsible for:
- Ensuring you have the right to upload employee data
- Complying with applicable data protection laws (including POPIA in South Africa)
- Obtaining necessary consents from employees
- Maintaining backups of critical data
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may:
- Perform scheduled maintenance with advance notice
- Experience occasional unplanned outages
- Modify or discontinue features with reasonable notice
9. Limitation of Liability
To the maximum extent permitted by law:
- EEMS is provided "as is" without warranties
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the past 12 months
10. Termination
Either party may terminate the service relationship:
- You may cancel your subscription at any time through your account settings
- We may suspend or terminate accounts that violate these terms
- Upon termination, you may request export of your data within 30 days
11. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance.
12. Governing Law
These terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.
